The Federal Family and Medical Leave Act (FMLA) grants eligible employees up to 12 weeks of unpaid job/benefits protected leave in a rolling 12-month period for one or more of the following reasons:
- The birth of a child, or placement of a child with you for adoption or foster care;
- Your own serious health condition
- You need to care for your spouse, child, or parent due to his/her serious health condition;
- A qualifying exigency arising out of the fact that your spouse, son or daughter, or parent is on covered active duty or call to covered active duty status with the Armed Forces;
- You are the spouse, son or daughter, parent, or next of kin of a covered service member with a serious injury or illness.
FMLA eligibility starts after 12 months of employment with the State of Idaho, and the employee has worked at least 1,250 hours at Boise State University within the last 12 months.
How to Apply
If you anticipate an absence of five or more consecutive days, or intermittent absence over a period of time for your own health condition, or to take care of an immediate family member, please notify Human Resources, or complete the form https://dhr.idaho.gov/PDFs/FMLA/FMLA_LEAVE_REQUEST_FORM_Interactive.pdf, and submit to Tiffany Widman, FMLA and Leaves of Absence Coordinator, within 30 days before your leave is to begin, or as soon as the need for leave is foreseeable. We will provide additional information and determine eligibility for FMLA.
FMLA is an unpaid leave; however, eligible employees may use accrued sick leave, annual leave and/or comp time to receive pay during their approved absence. In instances where the employee’s serious health condition is related to an occupational injury or illness, Workers’ Compensation may also provide pay during an FMLA-covered absence.
